that's what i like to call bullshit. if you were a hired professional guide then yes, that would be the case. other wise it is assumption of risk. climbing is dangerous, everyone knows you could die, end of story.

yes, super lame story by the way, and totally fictitious.
No, that's not B.S.

If you take a gumby climbing and fail to verify that he/she can tie a proper climbing knot and attach it to a harness then you should be liable, maybe not murder but at least negligent homocide.
wow, you must be a lawyer, or you are planning to be one.

if you want a guaranteed safe climbing trip and you are a beginner, then you should probably hire a professional, or take a class, or at least read a book. maybe the guy who fell in the first place should have asked someone to check his knot if he was unsure of his ability to tie one. i have never climbed with a beginner who would want to tie there own knot without any instruction or without having someone check it first. if you are too stupid to do that, then well, ask darwin.

Hey gripless, our legal system prosecutes people for less all the time.
The theory of evolution is just as stupid as the theories of gravity and electromagnetism.

gripless, clever. so what's your point saxballs? does that make it right or Ok? i assure you there is such a thing as assumption of risk. if there wasn't then you could go around suing every guy that ever gave you the clap.
